- commented that the draft Bill needed to be revised to ensure due attention had been given to the meaning and role of key concepts, such as "local network area", "connected generation", "connected customer" and "involvement"
- expressed our concern that the MED had not taken the opportunity to facilitate greater use of standby (diesel) generation as a cost-effective means of deferring network investment.

In this submission we:
- supported the Electricity Networks' Association's submission on the discussion document
- provided additional material in a submission from NERA Economic Consulting and Dr Mark Berry, Barrister
- recommended that a simpler, more refined purpose statement be developed for Parts 4 and 4A
- proposed a regulatory framework that comprised two pathways: a default price threshold and a customised proposal based upon a propose/respond model
- emphasised that a full merits review by way of rehearing is needed.

In this submission we:
- acknowledged that the Government is taking significant steps to encourage greater energy efficiency and a low emission future for New Zealand through the draft New Zealand Energy Strategy and associated documents
- emphasised that key initiatives must focus on efficient pricing, security of supply and reducing winter demand for electricity.

- agreed with the intent of the primary objectives and specific outcomes identified in the proposals
- emphasised that all utilities in the transportation corridor should be treated consistently and fairly
- emphasised that cost-sharing rules should be as simple as possible
- submitted that the network controller should have overall responsibility for ensuring that notice of proposed works is given to all affected parties.

Summary
In this submission we:
- highlighted that we strongly support facilitating distributed generation
- emphasised that links with other regulation must be clarified - in particular, the relationship with the thresholds regime created by Part 4A of the Commerce Act
- gave detailed reasons why the regulations should only apply to distributed generation of less than 5MW
- commented in detail on various clauses in the regulations.

Summary
In this submission we:
- gave detailed reasons why electricity distributors should be allowed to own distribution generation up to the greater of 50MW or 20% of maximum demand and to sell their output, without the need to comply with the cross-ownership rules under the Electricity Industry Reform Act 1998.
